Claire McCaskillSenator Claire McCaskill (D-MO) is the latest legislator to write FCC Chairman Kevin Martin and Assistant Attorney General Thomas Barnett contesting the proposed merger between Sirius and XM Satellite Radio. McCaskill asks for the merger to be “rejected” and says she does “not believe the merger is in the best interest of consumers.”

We’ll forget that included in “some” of that competition is subscription based music services Napster and Rhapsody.

McCaskill said that even though the satellite radio industry did receive some competition from broadcast radio and the digital marketplace, the service it provides is different since it’s subscription based. She also noted that both are free from decency and public interest requirements. Plus, she writes that both services have benefited from competition from one another. “A market, absent of this condition, would not protect consumers,” she added.
